According to the All Progressives Congress (APC) Presidential Campaign Committee (PCC), there is no legislation requiring INEC to send poll results online.
Mr Dele Alake, the PCC’s Special Advisor on Media and Communications, made the announcement during a news conference in Abuja on Friday.
According to Section 60, sub-section 2 of the Electoral Act, Alake stated that the transmission of election results was at the discretion of INEC.
According to him, there is no required provision in the Election Act 2022 addressing the transmission of results.
“The concern against electronic transmission of election results is not warranted by law,” he stated.
“Section 38 of the Electoral Act 2022 relied upon by the Peoples Democratic Party (PDP) and the Labour Party (LP) to contest the outcome of the Feb. 25 presidential election has nothing to do with the transmission of election results.
“Section 60, sub-section 2 of the Act deals with the transmission of results, which is at the discretion of INEC. The Act has no necessary provisions for the transmission of results.
“In any event, the procedure of transferring results from polling stations, whether in real-time, two days later, or at any moment, cannot in any way modify the results that have already been reported,” Alake emphasized.
He went on to say that what was crucial was the counting of ballots in the presence of party agents and officials.
Alake thought it was ludicrous to suggest that time differences in uploading findings would produce a change in the data.
“In any scenario, whether in real-time, two days later, or at any time, the procedure of transferring results from polling stations cannot in any way modify the results that have been declared,” he stated.
He went on to say that the press conference was to answer to both the PDP’s Alhaji Atiku Abubakar and the LP’s Mr Peter Obi, following their recent pronouncements against the election results.
He called the actions of the PDP, the LP, and the NNPP to go to court over the election results a positive step.
